ZURK - Warranty Policy

ZURK REFUND AND GUARANTEE POLICY

 

  1. All ZURK products come with a manufacturer’s Warranty. This Warranty only covers Manufacturer’s defects that are inherent and exist at the time of delivery. and does not apply to normal wear and tear, including wear of tires, hand grips, brake pads and scratches to the frame and/or seat. This Warranty applies only to products manufactured and sold by ZURK.

 

  1. “Delivery” means delivery of the product to yourself personally, your agent or the courier delivery service who is to deliver the product to yourself.

 

  1. ZURK represents to you that the ZURK bicycle is delivered:
    1. Suitable for its intended use; and
    2. in sound and safe condition;
    3. free of any known faults or defects; and
    4. in accordance with the Manufacturer’s standards.

 

  1. The only intended use of all ZURK bicycles is for use on paved roads only.

 

  1. This Warranty only extends to and covers inherent defects that exist in the ZURK bicycle at the time of delivery.

 

  1. ZURK’s responsibility and liability for all its products (except as contained in this Warranty) ends at the time of delivery.

 

  1. Title in the product passes to you at the time of Delivery.

 

  1. This means that any/all damage resulting to your new ZURK product from shipping, is your responsibility.

 

  1. You are responsible for insurance for your new ZURK product immediately from the time of delivery.

 

  1. ZURK provides a 2 year guarantee for manufacturing defects resulting in the failure of the frame and fork of ZURK bicycles.

 

  1. ZURK provides a 1 year Warranty for manufacturing defects in the battery, motor, controller, display, and sensors of all of its bicycles.

 

  1. The Warranty provided to you will only be effective if the following applies:
  • If the ZURK product was purchased from one of our authorized ZURK dealers or our distributors.
  • If you are the original owner of the ZURK product (Warranty is not transferable in the case of a re-sale).
  • If the ZURK product has only been used for its intended use.
  • If the electronics have not been repaired or modified.
  • If the bike was assembled by a certified E-Bike specialist or Bicycle Dealer

 

WARRANTY EXCLUSIONS

  1. The following exclusions to this Warranty apply:
  • This Warranty only applies to ZURK products sold within New Zealand.
  • This Warranty can only be changed and/or amended by ZURK. Any on going sales of any ZURK products are not covered by this Warranty.
  • This Warranty does not cover:
    • Normal wear and tear;
    • Damage or failure from abuse, neglect, misuse, or accident;
    • Damage from off-road or stunt riding, ramp jumping, acrobatics or similar activities or any activity that is not consistent with the intended use of the bike;
    • Damages resulting from improper charging of the battery pack or use of any charger not supplied by ZURK or its dealers;
    • Installation of any 3rd party parts, accessories, or electrical components;
    • Any components that have been modified or tampered with, including but not limited to tires, brake pads, chains, lights, motors, battery packs, displays, controllers, etc;
    • damage associated with commercial use or rental operations.
    • If electrical parts have been repaired or modified by a person not authorized by ZURK;
    • Lost or damaged keys.

 

INFORMATION ON WEAR AND TEAR

  1. Some components of your ZURK bicycle are subject to wear owing to their function.
  2. The extent of wear depends on the care, maintenance and nature of the use of your ZURK (mileage, riding in rain, dirt, salt, etc.). Bikes that are often left outside can also be subject to increased wear due to weathering.
  3. The parts must be replaced once they reach their wear limit. This includes but is not limited to:
    1. The drive chain or toothed belt;
    2. The brake cables;
    3. The rubber hand grips;
    4. The sprockets, pinions or toothed belt discs;
    5. The gear cables;
    6. The tires;
    7. The saddle cover;
    8. The brake pads;
    9. The rims or brake discs
  4. The brake pads and disks are subject to wear owing to their function. Check the condition of the pads regularly and, if necessary, have them replaced by a specialist dealer.
  5. Brake discs also wear out. Regularly have the thickness of the brake discs checked as part of inspection and replace the components, if necessary. Replacing these parts due to wear, is not covered by our Warranty.
  6. Environmental factors cause wear on these moving parts. These areas must be regularly cleaned and maintained.
  7. Depending on the operating conditions, it cannot be ruled out that parts will have to be replaced due to wear (e.g. if bearing play starts to occur). You must contact your dealer before arranging repairs in order to ensure the quickest and most cost-effective way to deal with your issue. Shipping and disassembly instructions from either the dealer or ZURK must be followed. Otherwise Warranty service will not be provided.
  8. Failure to comply with the assembly specifications and inspection intervals can void the Warranty and liability for defects.

 

LIMITATION OF LIABILITY

  1. The liability of ZURK with respect to all claims for loss, damage or injury arising from a breach of any of ZURK’s obligations or from any act or omission of ZURK, in each case, to the lesser of:
    1. replacement or repair of the affected Services and/or Goods;
    2. payment of the actual cost of replacing or repairing the affected Services and/or Goods; or
    3. the price of the affected Goods or Services.
  2. ZURK shall not be liable for any direct or indirect loss or damage (including without limitation loss of profits or savings or for any indirect or consequential loss or damage), however caused, arising out of or in connection with the supply of Goods or Services by ZURK.
  3. No action arising out of the supply of Goods or Services by ZURK, may be brought more than three months after the Customer becomes aware, or reasonably ought to have become aware, of the circumstances giving rise to the action.
